In a long running legal battle over the multimillion-dollar sale of a Mark Rothko painting, a Dallas federal judge issued two same-day rulings, allowing both sides to claim a victory.

In the memorandum and order, Chief U.S. District Judge Sidney Fitzwater denied attorney fees that the plaintiff Marguerite Hoffman had sought after she won a final judgment against one defendant. Fitzwater denied Hoffman the fees because the defendant was a limited liability corporation, and did not qualify under Texas law in this instance as a “corporation” or an “individual” subject to paying attorney fees, Fitzwater wrote.
