A bill that would create a new cause of action sailed unanimously through a House committee without any changes. Without debating the bill, the House voted 138-1 to pass it on May 15.

House Bill 3662 would allow a person or business to sue a state agency that brought a frivolous, unreasonable or baseless regulatory action against him. Before suing, the plaintiff would have to win an appeal from the administrative proceeding on the action. The plaintiff would only win if the agency could not show good cause for its action. A successful plaintiff would win damages, costs and attorney fees in defending himself in the administrative proceeding and appeal.
