With the Texas Legislature poised to legalize some people to carry handguns openly, it might be time for lawyers to counsel business clients about new policies, procedures and staff training.

Lawyers who represent businesses say that companies need to decide whether or not to allow open carry. They must train employees on the open carry statute and the company’s policy about it. If a business decides to prohibit open carry, it must determine what procedure to follow if a customer violates the policy and enters the business with a handgun. Lawyers are divided about whether allowing open carry could open a company to the risk of litigation.
