Following the advice “Don’t get mad; get even,” a group of unhappy investors recently went after Brian K. Alfaro, his San Antonio-based company Primera Energy and its affiliates, alleging fraudulent dealings. During the past several years, Primera has invested in oil and gas prospects in the Barnett and Eagle Ford Shale plays in Texas.
In April, a large group of investors filed the lawsuit, Patek v. Alfaro, in the 288th District Court of Bexar County. The plaintiffs alleged a number of causes of action under the Texas Securities Act, including fraud, fraud in a real estate transaction, and unconscionable and unsavory acts under the Deceptive Trade Practices Act.
