The U.S. Court of Appeals for the Fifth Circuit’s recent ruling concerns a tragic event in 2010 in which a fire at a Texas oil well owned by Endeavor Energy Resources killed two men employed by Basic Energy Services.

The event sparked litigation that centered on an insurance coverage fight between the insurers of the two oil companies involved in the drilling activity. Endeavor’s insurance company, Ironshore Specialty Insurance Company, was the plaintiff-appellant in the Fifth Circuit appeal, and Basic’s two insurance companies, Aspen Underwriting Limited and Dornoch Limited, were the defendants- appellees in the case.
