Family lawyers are ready to represent same-sex couples with drafting marriage agreements, becoming parents and getting divorces after the U.S. Supreme Court legalized same-sex marriage in late June.
Attorneys say they expect that litigation will ensue to answer a myriad of questions, such as: the effective dates of existing same-sex marriages; the ruling’s application to common-law marriages; and how people of failed marriages will divide their property in divorce. The ruling also revolutionizes the way that same-sex spouses will become parents in the eye of the law.
