Is the new federal water rule that was enacted on June 29 already dead in the water? The Texas attorney general recently filed a lawsuit on behalf of the state of Texas and a number of other parties against the U.S. Environmental Protection Agency seeking to vacate the new water rule that was recently enacted under the Clean Water Act.
The case, Texas v. EPA, was filed in the U.S. District Court in the Southern District, Galveston Division. According to the complaint, it is a challenge to the legality of the final rule titled “Clean Water Rule: Definition of ‘Waters of the United States,’” promulgated by the EPA and the U.S. Army Corps of Engineers.
