Just like with politics, dealing with environmental issues can often create strange bedfellows and even more unusual adversaries. Take, for example, a recent case decided by the U.S. Court of Appeals for the Fifth Circuit, which pitted a number of environmental advocacy groups against the U.S. Environmental Protection Agency rather than the usual industrial companies.
Created for the purpose of protecting human health and the environment, the EPA in Environmental Integrity Project v. EPA was put in the posture of defending the state implementation plan (SIP) that it had formerly fought in 2012 in an earlier case, Texas v. EPA.
