An appeals court recently denied an effort to have College Station lawyer Gaines West, his firm and another lawyer disqualified for allegedly switching sides to represent an opponent.

The litigants who sought the disqualification—Gloria Neal, Earl White, Michael A. White and Betty White—argued that West had violated attorney disciplinary rules because he originally filed an answer for them, but later switched sides and represented Eli Rebich, an adverse party. But Rebich countered that the Neal litigants knew for seven months that West represented him, and they were using a late-filed disqualification request as a “tactical weapon.” Also, the disciplinary rules didn’t apply in the situation, Rebich claimed.
