The U.S. Court of Appeals for the Fifth Circuit has certified a “postspill” class of investors who sued BP PLC for alleged misrepresentations about the scale of the 2010 Deepwater Horizon disaster that dumped 5 million gallons of oil into the Gulf of Mexico.
But the appellate court rejected certification for a “prespill” class of investors who sued the BP for its alleged misrepresentations about the safety issues on the drilling platform before it exploded, killing 11 workers.
