Excessive Force

Handcuffed inmate awarded $1,000 for alleged beating

On July 15, a jury awarded $1,000 to an inmate who claimed a fractured left finger and a boot print on his forehead. Joshua Goudeau was an inmate in the Michael Unit of the Texas Department of Criminal Justice, in Tennessee Colony in 2011. He was returning to his cell after visiting the day room. Two correctional officers, Barry Andrew and Austin Benton, were escorting him, and he was in handcuffs. Goudeau claimed that Andrew punched and kicked him in the face, slammed him to the floor and broke his left finger without any provocation. He was examined by a nurse, who noted the boot print on his forehead. His attorneys argued for $1,000 to $20,000 in damages. The jury found cruel and unusual punishment by Andrew through the use of excessive force.
