Phillip Sampson and Christopher Dodson, two partners in Houston’s Bracewell & Giuliani, scored a major defense victory last month for their client Vopak Terminal Deer Park, a bulk liquid terminal operation with a flagship in the Houston Ship Channel, thanks to their discovery findings.
In Vertical North America v. Vopak Terminal Deer Park, a state district judge in Houston entered a final judgment dismissing $30 million in claims against the company, after the partners argued that the plaintiff had no claim to assert because a purchase and sale agreement showed that the claims that they alleged belonged to a U.K. company, which was not named as a plaintiff.
