Employees lose harassment claim

On Oct. 6, workers at an oilfield equipment supplier lost their racial harassment claim. Eight workers at National Oilwell Varco sued the company under Title VII for unlawful harassment based on race. They claimed they faced racial slurs daily. The jury found for the defense. Specifically, the jury did not find unlawful harassment based on race; did not find that Vital worked as a lead while being paid less than others for the same work; did not find that race was a motivating factor in Lane’s termination; and did not find that Johnson complained about or reported racial discrimination. The jury awarded zero actual damages and did not find that the plaintiffs proved they should be awarded punitive damages.
