A straight defense verdict in a patent infringement case in Marshall federal court has halted a potentially monopolistic force in the reflective insulation industry, according to Brett Govett, a partner in the Dallas office of Norton Rose Fulbright. Govett secured the victory for his client, Markleville, Indiana-based Reflectix Inc. Govett said that a plaintiff win would have caused a lot of problems for the industry. A victory by Plano-based Promethean Insulation Technology would have most likely led the company to file claims against other players in reflective insulation, based on the same patents, and thereby limited market competition, Govett argued.

After a four-day trial, and less than four hours of deliberation, a federal jury in Marshall delivered the take-nothing verdict for Reflectix, which is a subsidiary of Charlotte, North Carolina-based Sealed Air Corp.
