An interesting post by blogger/lawyer Leiza Dolghih, popped up in her June 22 blog post, North Texas Legal News: “What You Should Know About Non-Compete Agreements in Your Industry.” Dolghih reports on a recent study with some interesting stats: 25 percent of workers in the U.S. have signed non-compete agreements; 40 percent reported that they did not read their non-competes; only 8 percent consulted with a lawyer before signing one; and that non-compete agreements are more likely to be signed in states with higher non-compete enforcement policies (like Texas).

The study raises two interesting issues: in a pro-enforcement state, how do you attack a non-compete, and a more over arching one: (given that employees are not keen reading them). Is it time to deep six the idea of a non-compete?
