In 2015, legislation and court decisions across the United States have tightened up information security standards and enhanced regulation and litigation arising out of data security incidents and breaches.

The Data Security and Breach Notification Act of 2015, potentially the first national data breach notification law in the United States, is stalled in Congress. It would impose uniform requirements on companies handling data and preempt the various state laws governing information security and notification standards. While there is continued interest in a national regime for data privacy and security, the states have tried to fill the gap.
