In an employment discrimination lawsuit against a railroad company in a Fort Worth federal court, both sides have filed motions for sanctions about controversial events that took place during a contentious deposition.
In its motion, Burlington Northern Santa Fe (BNSF), the defendant railroad company, seeks sanctions as well as a contempt order against the plaintiff for spoliation of evidence. BNSF’s motion alleges specifically that the plaintiff Kasonia Carter and her attorney Hiram McBeth, a Dallas solo, removed papers from a folder used to prepare for a deposition before giving the folder to BNSF lawyers. According to the BNSF motion, Carter was required by a court order to give the railroad company the entire contents of the folder, but she failed to do so. Russell Cawyer, a partner in Fort Worth’s Kelly Hart & Hallman, represents BNSF.
