Texas is now seeking to have the U.S. Court of Appeals for the Fifth Circuit clear the air about the latest dispute it is having with the U.S. Environmental Protection Agency.

The state and the federal agency are tangling over the rule that the EPA recently issued to take the place of the state’s proposed revision to its state implementation plan (SIP) for cutting regional haze.
