In a race-discrimination employment lawsuit in Dallas federal court, corporate defendants filed a motion for sanctions against the plaintiff, a certified nursing assistant. The defendants’ motion alleges the plaintiff’s side engaged in spoliation of evidence and specifically, that the plaintiff’s lawyer failed to produce relevant email correspondence. The defendants’ motion also seeks about $7,000 in attorney fees.

The defendants, which the Dallas-based law firm Winstead represents, also allege that the plaintiff claimed to have lost records of cell-phone texts between herself and one of her former fellow employees. The defendants sought those text messages prior to a scheduled deposition of that former fellow employee. The defendants sought to question that fellow former employee after she signed an affidavit, which made “unfounded assertions,” about the plaintiff’s employment, the sanctions motion states.
