In a patent dispute about a mobile payment technology, a Tyler federal magistrate has set an April 22 deadline for a corporate defendant to respond to a motion for contempt and another motion seeking enhanced attorney fees.
The plaintiff, Boston-based SCVNGR, which does business as LevelUp, is seeking the enhanced fees and contempt ruling. LevelUp based its request for enhanced fees on allegations that the defendant, New York-based DailyGobble, made the litigation vexatious. LevelUp filed its motion for contempt under seal.
