Wharton County District Attorney Ross Kurtz’s alleged offhand comments about striking black people from juries concerned one of his prosecutors and attracted tough questions from a local judge. But it looks like the comments won’t launch an attorney disciplinary matter.

The State Bar of Texas recently dismissed a grievance against Kurtz based on his alleged advice to two assistant DAs that they should use peremptory strikes to eliminate black people from juries, said Houston criminal-defense lawyer David Kiatta, who filed the grievance. Kiatta said he’s disappointed that the bar dismissed his grievance. He appealed the dismissal to the Texas Board of Disciplinary Appeals.
