U.S. Senior District Judge David Ezra in Austin vacated a Rule 11 sanctions order he has previously issued against Houston lawyer Brian Zimmerman and his former clients, plaintiffs who had filed claims under the Racketeer Influenced and Corrupt Organizations Act in a long-running lawsuit.
In his most recent ruling, Ezra wrote that when he issued his previous order, he was unaware that the defendants in the litigation, who had sought the Rule 11 sanctions, had failed to comply with the safe harbor provisions set forth by Federal Rule of Civil Procedure.
