The Texas Supreme Court recently turned down a request to rehear a motion filed by McDaniel Partners pertaining to its royalty battle with Apache Deepwater. The high court took this recent action after it had ruled back in February that Apache was not obligated under the lapsed oil and gas leases to continue paying royalties.
In its opinion issued by Justice John Devine on Feb. 26, the Texas Supreme Court rejected McDaniel’s contention that a group of related West Texas mineral leases had to be treated as a whole. McDaniel then turned around and moved for a rehearing in the case.
