The Texas Supreme Court recently expanded the accommodation doctrine—an important concept in oil and gas law—to groundwater estates.
The recent case involves a conflict related the city of Lubbock’s attempt to drill additional water wells under land owned by Coyote Lake Ranch. In 1953, the city bought the right to the ranch’s groundwater through a deed executed by the ranch, with the ranch reserving water for domestic use, ranching operations, oil and gas production, and agricultural irrigation.
