With 12 federal judicial vacancies, Texas has more empty benches than anywhere else in the country.

It’s becoming a serious problem, especially in venues such as the Eastern District of Texas, which is home to the nation’s busiest patent docket. Down from eight active judges to just five, the Eastern District’s docket has now ballooned to 1,261 weighted cases per court, the highest in the nation.
