Escargot and employee lawsuits—both are often best gulped down, holding your nose. Squaring off against a single employee is tougher than it sounds. Damages may be relatively low. But defensive attorney fees can eat in-house counsel alive, which might make larger settlement numbers look tempting. Traditional discovery and summary judgment can run up the tab fast. What if the lawsuit could be KO’ed faster?

A motion to dismiss rarely does the trick. Few plaintiff’s lawyers will take a case knowing they’ll get poured out so early.
