A jury awarded $15,525 to a woman who claimed minor back and neck injuries in a rear-ender. Melissa Molina was hit by William Smith Jr., who conceded liability. The plaintiff was diagnosed with soft-tissue cervical and lumbar injuries that required a year of physical therapy. She claimed residual pain and limitations performing activities of daily living. The defense argued that Molina didn’t sustain a permanent injury.
Defendant 80 percent liable, jury finds
A driver who claimed back and neck injuries in a rear-ender recovered $16,708. Santos Ponce sued Grant McCullough for hitting him in Houston. Ponce claimed that he was speeding. Defense counsel presented a witness who said that Ponce was parked in the lane before he was hit. Ponce testified that he was on his way to a job site nearby and that he was going 40 mph when McCullough hit him. The jury found McCullough 80 percent liable and Ponce 20 percent liable, which reduced its award.
