The Texas Supreme Court has rejected BP America Production Co.’s request that the justices take away decision-making power from juries.

Instead the state’s highest civil court ruled in a significant case for the energy industry, BP v. Laddex, that a retrial was necessary so a jury could decide what length of time should be used in determining when BP’s operator mineral-rights lease expired due to the well no longer producing “paying quantities.”
