“Hazy” pretty much describes the forecast after a ruling this month sent the Texas Regional Haze Rule back to the Environmental Protection Agency for retooling.
None of the parties won precisely what they sought from the the U.S. Court of Appeals for the Fifth Circuit. Its March 23 ruling instead served to prolong litigation pitting the Obama administration’s EPA and environmental groups against Texas and others opposing haze regulations that called for limits of sulfur dioxide emissions from coal-fired power plants.
