Cole v. Dretke

"[T]he jury could have considered Cole's family background and organic deficiency evidence under at the least the future dangerousness special issue. Given the experts' testimony during the punishment phase, the jury could have believed them and found that, although Cole suffered a turbulent childhood and may suffer from diminished impulse control, he is capable of change and thus would not necessarily remain a danger in the future."
