Because the 9th Court of Appeals failed to consider the issue of causation in the disability case concerning a sheriff's deputy, the Texas Supreme Court did not reach the state constitutional law issue of whether a county must pay benefits to a deputy sheriff for an injury that occurred during a previous sheriff's term.
