Five years ago in a decision that strengthened the standard applied to scientific testimony, the Texas Supreme Court kicked out the same kind of case that on April 19 resulted in a $69 million verdict in Maverick County.

The cases involve the same defendant company — E.I. du Pont de Nemours & Co; the same type of plaintiffs -� pecan orchard growers; and the same allegation -� that the fungicide Benlate damaged their crops.
