    The Bustamontes alleged that Pontes negligence led their premature baby to suffer permanent vision loss. A jury agreed, awarded a total of $2.1 in damages, and held that Ponte was 45% responsible. A divided court of appeals reversed, concluding that the Bustamontes had failed to show that Pontes conduct was a but for cause of the injuries. The court reversed.
