The grant of summary judgment in a licensing dispute between a hunting and fishing television show and a snack and beverages marketing company has opened the door to a possible award of more than $6 million in the case.

Last month, a judge with the U.S. District Court for the Western District of Pennsylvania awarded The American Outdoorsman Inc. summary judgment on whether Shadow Beverages and Snacks LLC would be liable for all the guaranteed royalties outlined in a licensing agreement intended to span 10 years. The plaintiff was expected to file Monday its report outlining the total damages in the case as $5.9 million for breach of contract, and $150,000 in costs and attorney fees.

According to an opinion issued Dec. 19 by U.S. Chief Magistrate Judge Maureen P. Kelly, The American Outdoorsman, which broadcasts a weekly hunting and fishing program to local cable affiliate stations nationwide, agreed to allow Shadow Beverages and Snacks to use its name and logo on non-alcoholic beverages, beef jerky, nutritional bars, trail mix and other snacks. However, the marketing company did not make its first three royalty payments, and the agreement was terminated after 18 months.
