A $2.6 million suit filed by a bank against an insurer has survived a motion to dismiss in federal court in Pittsburgh.

First National Bank had filed suit last summer making three claims against Transamerica Life Insurance Co.: breach of contractual obligations, breach of fiduciary duty and insurance bad faith.

All but the claim of breach of fiduciary duty survived, according to an opinion issued Jan. 23 by U.S. Magistrate Judge Cynthia Reed Eddy of the Western District of Pennsylvania.
