Pennsylvania's Office of the Attorney General wants to claw back 28 pages of lawyer's notes that it accidentally handed over in discovery in a case filed by a former state trooper against the Pennsylvania State Police.

The federal judge in charge of the case, U.S. District Judge Mark R. Hornak of the Western District of Pennsylvania, issued an opinion on the matter, but held off on ruling until he hears oral argument on the motions for summary judgment.

The Attorney General's Office is handling the defense for the state police in this employment dispute, but the state's Office of General Counsel had represented it during an earlier, related arbitration. That's when the defense lawyer from the OGC made 28 pages of notes in preparation for the arbitration proceeding that were later included with papers related to the case that ended up with the Attorney General's Office when this current litigation arose.
