The Pennsylvania Superior Court has reinstated former CBS news anchor Alycia Lane's lawsuit against CBS and former co-anchor Larry Mendte over his hacking of Lane's emails and CBS's failure to stop him.

The court upheld, however, the dismissal of Lane's defamation claim over CBS's statement announcing the termination of her contract with the station.

The court found in Lane v. CBS Broadcasting that Philadelphia Court of Common Pleas Judge Allan Tereshko's ruling that Lane intentionally threw out a laptop to destroy evidence was not “tenable,” but the appeals court stopped short of agreeing with Lane's claims that Tereshko was biased in his rulings against her.
