The state Superior Court upheld a verdict in favor of an eye surgeon in a case where a man claimed the doctor's inadvertent anesthesia injection caused him to go blind in one eye.

A split three-judge panel in Chiodetti v. Fernandes affirmed Philadelphia Court of Common Pleas Senior Judge Mary D. Colins' ruling in favor of Dr. Eugene Fernandes.

Superior Court Judge Paula Francisco Ott wrote in the court's majority memorandum the court agreed with plaintiff Gary Chiodetti's claim that a defense expert, Dr. Nicholas T. Iliff, testified beyond the scope of his report by changing his opinion on the cause of the plaintiff's blindness.
