A Pennsylvania federal judge has thrown out a legal malpractice case against Spector Gadon & Rosen and its partner, Alan Epstein, over the firm's handling of an employment contract dispute.

U.S. District Judge Joel Slomsky of the Eastern District of Pennsylvania granted Spector Gadon and Epstein's motion for judgment on the pleadings in a consolidated case that also includes the firm's suit against former client Robert M. Fishman for unpaid attorney fees.

Fishman, an attorney himself, sued Epstein and Spector Gadon for professional negligence and breach of contract, arguing Epstein failed to act on an oral settlement offer from Fishman's former employer, resulting in Fishman having to hire new counsel and settle for less than the original offer, according to the complaint in Spector Gadon & Rosen v. Fishman.
