The gay lawyer who sued two law firms in federal court over a scuttled lateral move is contending that the defendants’ efforts to dismiss his claims of discrimination, retaliation and defamation have misrepresented his prior statements.

Late last month, Anapol Schwartz and Raynes McCarty, the defendants in a suit filed by plaintiff Jeffrey Downs, renewed attempts to have the case dropped by arguing that a defense verdict in a related state court action barred some of his federal claims, and that admissions Downs made in the state suit are fatal to his federal claims.
