A federal judge in Pittsburgh has barred an expert's testimony on “implicit bias” in an age discrimination case.

U.S. District Judge Terrence F. McVerry of the Western District of Pennsylvania denied attempts by five plaintiffs in the case Karlo v. Pittsburgh Glass Works LLC to introduce testimony from a psychologist about his findings that most people display a subconscious implicit bias.

While at least one federal court has allowed the expert to introduce the findings of his tests, McVerry agreed with an Illinois district court that the expert's testimony was not concretely centered in the facts of the case.
