The state Superior Court has revived a man's products liability suit against Lowe's and the makers of a lawnmower, which he alleges caught fire after the first use and burned down his barn.

The state Superior Court has revived a man's products liability suit against Lowe's and the makers of a lawnmower, which he alleges caught fire after the first use and burned down his barn.
A unanimous three-judge panel of the court reversed a decision from the Washington County Court of Common Pleas that had tossed the case for failing to state a claim. The decision in Barton v. Lowe's Home Centers was issued Sept. 24 in a precedential opinion.
According to Superior Court Judge Patricia H. Jenkins, the trial court had placed “too onerous” a standard on plaintiff Tredd Barton's third amended complaint.
