A federal judge has denied a request for summary judgment from H.J. Heinz Co.'s insurer claiming the food company wasn't fully transparent about a series of contaminations in its products.

Starr Surplus Lines Insurance Co.'s motion for rescission of Heinz's policy came by way of a counterclaim to Heinz's breach of contract suit against the company for refusing to pay coverage stemming from losses incurred from accidentally contaminated foods.

U.S. District Judge Arthur Schwab of the Western District of Pennsylvania ruled that summary judgment wasn't appropriate because there were still issues of fact remaining in the insurance dispute.
