A former FedEx saleswoman's age discrimination case alleging she was targeted for termination because of her age and subsequently replaced with a younger employee will be decided at trial, a federal judge has ruled.

U.S. District Judge Mark Kearney of the Eastern District of Pennsylvania declined FedEx's request to toss plaintiff Justine Larison's case. Kearney said in his opinion that the issues Larison raised had to be addressed by a jury. Kearney did, however, dismiss Larison's retaliation claim.

Larison alleged that she was written up for not meeting sales goals by her manager, Stephanie Nardiello, despite having generally positive performance reviews.
