A federal judge has refused to grant interest and attorney fees on top of a $4 million award Temple University Hospital scored against the federal government stemming from a medical malpractice case.

Temple's request for fees and interest came two months after U.S. District Judge Mark A. Kearney of the Eastern District of Pennsylvania ordered the government to pay half of an $8 million settlement of a birth injury case against the hospital. Kearney ruled in favor of Temple after it sued the government for indemnity, arguing that a labor and delivery doctor found liable for causing birth injuries was a federal employee.

However, Kearney rejected Temple's arguments seeking additional money.
