State Sen. Sharif Street, D-Philadelphia, issued a memorandum declaring his intention to introduce a measure that would guarantee legal representation in certain civil asset forfeiture cases.

The representation would be funded by a $2.25 increase in civil filing fees under Street's proposal.

Street said his legislation will require mandatory counsel for forfeiture actions involving real property. Judges would determine if counsel is required in forfeiture actions involving other property. Counties would be required to develop programs and procedures to ensure that counsel is available for forfeiture cases.
