A former high school student who was sexually assaulted by her teacher can move forward with her state-created danger claims against the school district, which was allegedly aware of reports that multiple teachers were having sex with students.

U.S. District Judge Nora Barry Fischer of the Western District of Pennsylvania denied Plum Borough School District's motion to dismiss the complaint brought by a Jane Doe plaintiff.

Fischer reasoned that the administration's awareness of possible sexual activity between teachers and students, along with former school resource officer Mark Kost's alleged attempts to downplay the rumors and his preference for internal investigations over police involvement, harmed the plaintiff.
