A federal judge served up a debilitating ruling to Bob Evans, immediately ruling in favor of a pregnant woman who sued the restaurant chain after she was effectively dismissed because of her pregnancy.

U.S. District Judge Mark Hornak of the Western District of Pennsylvania granted summary judgement for ex-Bob Evans waitress Hayley Macioce, whose Title VII discrimination suit was picked up by the Equal Employment Opportunity Commission.

Macioce worked at a West Mifflin Bob Evans restaurant when she was pregnant. According to Hornak's opinion, she was taken off Bob Evans' automatic scheduling system by a supervisor who told her he didn't “want to get screwed over if [she had] the baby.”
