The Commonwealth Court has upheld a ruling letting Montgomery County out of a case brought by the Archdiocese of Philadelphia, in which the church sought $1 million of liability insurance from the county.

The three-judge panel affirmed a Montgomery County judge's grant of summary judgment to the county. The church argued it was the duty of the county to provide insurance coverage for a slip and fall that occurred while the county was renting out St. Patrick's Parish church as a polling place.

The church pointed to a license agreement between it and the county—signed in 1989 and renewed every year after—that generally states the county will maintain liability insurance for the premises. The county claimed it was immune under the Tort Claims Act. Summary judgment was then granted in favor of the county.
