A woman claiming she was injured while exploring a brain-themed exhibit at the Franklin Institute can proceed with allegations of negligence against the Philadelphia-based science museum, the Pennsylvania Superior Court has ruled.

A unanimous three-judge panel issued a memorandum Sept. 8 finding there is evidence in the case that could allow a fact-finder to render a decision in favor of Christina Alloway, who has alleged an uneven surface caused her fall.

In August 2014, Alloway was a patron of the Franklin Institute and entered the Neural Climb attraction at the museum's Brain Exhibit. Upon exiting the exhibit, which she described in a deposition as “'a dark place, very few lights, with some netting and platforms to climb through,'” she stepped down and sustained an ankle injury, the opinion said.
